The Compulsory Registration of Marriage Act

Marriage is no longer a divine union that requires celestial blessings included in the various religious rituals associated with it. It has got far reaching legal consequences too. It is for this legal reason that we have to consider this law. Moreover, the growing number of divorce cases, cases regarding custody of children and maintenance, polygamy, and dowry deaths reveal that marriage is no longer considered as a divine union by the society. Hence let us not be under the illusion that this law would violate the sacredness of marriage rites.
IS THIS A NEW LAW?
As it is, any Indian citizen who opts to marry under the Special Marriage Act of 1954 automatically has the marriage registered by the marriage officers who has been specially appointed for the purpose.
The Indian Christian Marriages Act of 1872 also demands for compulsory registration of marriages. Accordingly entries are made in the marriage register of the church, soon after the ceremony along with the signatures of the bride, bridegroom, the officiating priest and witnesses. The Registration of marriages is mandatory under the Parsi Marriage and Divorce Act of 1936. Marriage being a civil contract for the Muslims, the qazi records the terms of the marriage in a nikahnama and hands it over to the married couple. It is only under the Hindu Personal Law that it is not compulsory to register the marriage.
IMPLEMENTATION OF THE LAW
Certain State governments have out of the their concern to stop the crimes committed against women and children made the registration of marriage compulsory. They believed that giving legal status to wedlock would strengthen the institution of marriage. Thus we had,
PROBLEMS DUE TO NON-IMPLEMENTATION OF LAW:
The non-registration of marriage under Hindu Marriage Act has given rise to two major problems.
The Hindu Marriage Act on bigamy has got many loopholes. The Section 494 of the Indian Penal Code also has some faults while dealing with the offence of remarriage of husband or wife when the either of them is alive. So far these laws required that certain ceremonies have to be performed for a marriage to be valid. These ceremonies could be done according to the caste and religion of the bride and the bridegroom. Unless these ceremonies are performed the marriage is considered to be invalid. This holds good for bigamous marriage too. Women are the primary victims of bigamous relationships and they are the most affected ones because of the non-registration of marriage. They find it difficult to get property or maintenance in case of dispute, as they are not able to produce any proof for the validity of their marriage. There are umpteen cases where the wives have lost their case because of their inability to prove their first or second marriage of their husbands.
The second major problem caused by the non-registration of marriage is the problem of Child marriage, which is indeed a serious national problem. It is estimated that almost half of all marriages that is conducted in India involves under-aged girls. The Child Marriage Restraint Act of 1929 has prescribed 18 years as the minimum age for girls and 21 years for boys for getting married. This law is applicable all over India except the State of Jammu and Kashmir. Recall and focus on what made you fall in love, and try to help your spouse see what they love about you. Sometimes, people “fall out of love” and seek a divorce, but they just need to me reminded of why they fell in love in the first place.
You should be in touch with your spouse’s needs to improve the relationship. There is obviously something missing in the marriage for one of you to want a divorce. Without knowing what made your spouse fall out of love with you, you can never win them back. If you determine what your spouse desires from you, you can start meeting these desires and begin to save your marriage. You need to save your marriage.
You should not become defensive or accuse your spouse of something if they are being critical about portions of your relationship. They are complaining because they feel unheard. Focus on the feedback so that you can learn from it.
Focus on changing yourself to save your marriage. View all comments and criticisms constructively to make the necessary adjustments.
One thing that is worse than you becoming defensive is if you refuse to acknowledge the feelings your spouse may have. Making remarks like “That doesn’t make sense” or “you’re bringing that up again?” are never helpful. accomplishes nothing except showing your spouse you don’t care about how they feel. Even if the complaints seem trivial to you, you should never consider your spouse’s actions or statements about them to be trivial, as such complaints often lead to divorce, which is never trivial.
To help defuse conflict, try to send “I” messages, as opposed to “you” messages, such as “I feel unappreciated”, as opposed to “you make me feel unappreciated”. These statements shouldn’t be used to place blame or make accusations, and they also should avoid being cruel. Experts advice to express your feelings to your partner. To let them know who you are and how you feel about the situation. Using this method will help you in pushing back any feelings of over powerfulness.

Think about it. As we drive down the street the car in front is driving a couple miles an hour slower than we are. Automatically we become frustrated. We call the driver all sorts of names and even call his ancestry into question. We seethe and fret and fume until we almost burst a blood vessel. And all of this because in our minds we are the perfect driver. And this idiot ought to get off of the road. Where did he get his drivers license anyway? Out of a Cracker Jack box?
Now let’s take it a bit closer to home. Have you ever been washing the dishes only to be told you did not know what you are doing? First you have to rinse them, then stack them, then fill the sink with just perfect water temperature. Then add this many squirts of Dawn. Nothing else will clean as well as Dawn, don’t you know? And don’t rinse them in hot water. Use cold water. Dummy. Don’t you know any thing?!! Sheesh!
Now I ask you. How many folks are washing dishes daily and have been for years? How many of them follow the exact formula your spouse laid out for you? NONE! That is right. A big fat Zero. And you know what? All of those dishes still get washed and none of those folks died because someone’s magic dish washing formula was not used.
If you are the one doing this sort of judging and controlling (it is actually emotional and psychological abuse), can you see how destructive this is to your marriage? How would you react to your spouse doing this? If you happen to be the one helping, how often will you continue to offer your services if you are abused in this way? Not many would be my guess.
Can you see how if you are guilty of this behavior why it could be a cause of divorce. I would just throw my hands in the air and tell you to do it your own self. And so will they, sooner or later. Probably sooner than later. It may have already happened and you wonder why they no longer help with chores.
Listen up. If this is happening in your marriage your marriage is in big Trouble. With a capitol T. You will soon harvest what you have been planting. And you have no one to blame but yourself. If you want a sure fire cause of divorce, just be this person.
A much better way and by far more productive, tell your helpful spouse what a great job they are doing and how much you appreciate their help. When you see how much they try to please you because you support their efforts, you will wonder why you never did it before.
One of the best descriptions I have found is, Love endures long and is patient and kind; love never is envious nor boils over with jealousy; love is not boastful or vainglorious, nor does it display itself haughtily.
There’s enough causes of divorce in every marriage. Please, please, please do not demean each other and make them feel stupid and incompetent by treating like they are. Anyone can tear another down.
